WA - Director's Safe Harbours - Creditors Beware!

The ATO states that safe harbour provisions aim to ensure services provided to the public are of an ethical and professional standard.

On September 11, 2017, the Treasury Laws Amendment (2017 Enterprise Incentives No. 2) passed through the Senate with certain amendments.

Speaker Profile - Carl Huxtable

Having started in the insolvency and turnaround industry in 1999, Carl registered as a liquidator in August 2005, just after being named the Western Australian Young Credit Professional of the Year. He was an original board member for the Turnaround Management Association - WA Division, as well as a councillor for the Australian Institute of Credit Management for a number of years.

Insolvency is a perfect fit for Carl’s interest in investigation and identifying the causes of financial distress. Identifying these issues allows Carl to assist clients navigate out of the red and back to black. His investigations have been the subject of Court proceedings resulting in asset freezing orders, international extradition orders and successful prosecution of fraud and theft charges.

 Carl’s other professional interest has been the Personal Property Securities Act and its interaction with insolvency matters.  He notes that whilst the Act has many opportunities for secured creditors to incorrectly secure their rights, the test for those errors generally arise in distressed circumstances where the asset is the subject of recovery claims from either the secured creditor, liquidator or administrator.

Carl has also been published in the Australian Insolvency Journal and regularly writes and presents papers for Legalwise Seminars and other technical groups.
